On one of the tobacco websites I visit...

URGENT !!! CONTACT YOUR U.S. SENATORS THIS WEEK !!!

*** DO NOT LET CONGRESS TAKE AWAY YOUR RIGHT ***
*** TO PURCHASE TOBACCO BY MAIL OR INTERNET!!! ***

Be sure to contact your U.S. Senator's offices THIS WEEK to vote "NO" on S.1147 that will make it illegal for you to purchase tobacco products by mail or by Internet. This will be voted on this Thursday 11/5/09.

Dial 1-800-828-0498 and ask for your Senator's office.
Identify yourself as a constituent of that state.
Say, "I am calling to register my request to please vote NO on S.1147" (You do not have to say you are a smoker - just a constituent.)
Be polite and concise, and do it twice. (Call both your U.S. Senators)

If you want to give a more specific reason to vote no, following are some of the arguments against S.1147:

Undue hardship presented to many smokers who are older and shut-in with limited mobility. It is unfair to prevent them from buying tobacco products through home delivery.
Discriminatory pricing as the majority of smokers are lower-income, many on a fixed income. It is discriminatory to force them to pay higher prices.
Discriminatory taxation as smokers were forced to pay an additional increase of more than $7 a carton in new federal taxes earlier this year.
Unlawful double-taxation as Internet and mail-order retailers are already collecting and paying federal and state excise taxes in the state where the tobacco is purchased.
Discriminatory restriction of trade towards smokers as any other lawful product can be purchased through mail-order and through the Internet.


Two more days and we may never be able to purchase tobacco and have it delivered again.

Time is crucial at this point, so a phone call is by far the best choice for contacting your Senators.

EMAIL: Simply go to each of your two Senators websites shown above and find the Senators contact form. Fill in the required information, type your message and click the "Send" button.

EVERY TELEPHONE CALL, EMAIL AND LETTER MAKES A DIFFERENCE.
YOUR SENATORS NEED TO HEAR FROM YOU ON THIS IMPORTANT ISSUE!

THE SITUATION: Right now there is legislation pending in the United States Senate - the Prevent All Cigarette Trafficking Act of 2009 ("PACT Act") (S.1147) which contains, among other bad ideas, a provision to make ALL cigarettes and smokeless tobacco products nonmailable. This legislation has already been passed by the House of Representatives and is currently in a Senate Committee that could send it to the Senate floor at any time for a vote!

WHAT THIS MEANS TO YOU: By making all cigarettes and smokeless tobacco products nonmailable, the Senate is ensuring you will no longer be able to purchase these products by mail-order, telephone order, or over the Internet because the United States Postal Service, along with UPS, Fed-Ex and all other carriers, will be prohibited by law from delivering your orders to you. Taking away your options means forcing you back to buying over-priced tobacco products from your local retailer once again.

WHAT YOU CAN DO: Contact your Senators and tell them not to pass the PACT Act. Your Senators should be protecting your interests, but it is up to you to let them know what you think about the PACT Act. There are three easy ways to contact your Senators - by telephone, email, or regular mail - all of which are explained below. Every state has two Senators - please remember to contact BOTH Senators for your state. At this point time is crucial, so a phone call is by far the best means to use.

YOU HAVE THE RIGHT TO EXPRESS YOUR OPINION: As an American Citizen, it is your right to let your Senators know how you feel about any action Congress takes. You elected your Senators to represent you and they can only do this if you tell them what you want. When you contact your Senator you do not need to identify yourself as a smoker or as someone who purchases cigarettes and/or smokeless tobacco products by mail-order, telephone-order, and/or the Internet. You only need to identify yourself as a resident of the state they represent.

SOME CONCERNS ABOUT THE PACT ACT TO DISCUSS WITH YOUR SENATORS:

THE POSTAL SERVICE: The price of stamps is being raised practically every year. The PACT Act will take an entire class of legal, non-hazardous goods and make them nonmailable. What this means is a huge loss of business (potentially hundreds of millions of dollars) for the Postal Service. Will they continue to raise the price of stamps and other mail services to compensate for their lost income? The United States Postal Service is already suffering a fiscal crisis due to the downturn in the economy. If the PACT Act is passed and millions of dollars of revenue are taken away, there could be serious consequences for consumers, including reducing the number of delivery days from 6 per week down to 5 or perhaps only 4 days per week.

COST: When the PACT Act of 2003 (S.1177) passed the Senate, the Congressional Budget Office prepared a Cost Estimate for the Bill. The Congressional Budget Office estimated that the PACT Act of 2003 would cost about $140 MILLION over the 2004-2008 period to enforce. $140 Million over four years - and that estimate is already six years old. How much will the PACT Act of 2009 cost to enforce? Isn't there a better way to spend our tax dollars?

IMPORTANT THINGS TO REMEMBER WHEN COMMUNICATING WITH YOUR SENATORS:

1. Tell your Senators that you are one of their constituents and provide an address so they know where in the state you are from. Since anyone can contact a Senator, it is important that you let your Senators know that you live and vote in their home state. Because the Senators receive so much mail, mail from their constituents always takes priority.

2. Make it clear to your Senators that you DO NOT want them to pass the PACT Act of 2009 (S.1147). Let your Senators know that if they don't support you - you won't support them.

This legislation contains, among other bad ideas, a provision which would make ALL cigarettes, RYO and smokeless tobacco products nonmailable. This bill has already been passed by the House, and if approved by the Senate Judiciary Committee, could be sent to the full Senate floor for a vote at any time!
By making all cigarettes, RYO and smokeless tobacco products nonmailable, this law means you will no longer be able to purchase these products by mail-order, telephone order, or on the Internet, because the United States Postal Service, along with UPS, Fed-Ex and all other carriers will be prohibited by law from delivering your orders to you. Taking away your options means forcing you back to buying over-priced tobacco products from your local retailer. Let your Senators know that you don't want this!
If you wish to preserve your rights and freedoms, you have to make your opinion known and your voice heard. Contact your Senators today and tell them to vote NO on S.1147, the "PACT Act"!

This bill was considered in committee on Nov 19, 2009. They recommended it be considered by the Senate as a whole. S.1147 was Placed on the Senate Legislative Calendar under General Orders. Calendar No. 216. Thomas Library of Congress Link

Note that this bill is essentially the same as H.R. 1676: PACT Act which passed the House on May 21, 2009 with Bipartisan support. The totals were 397 Ayes, 11 Nays, 25 Present/Not Voting. H.R. 1676: Vote Details

well judging from earlier votes we are going to be doomed to over the counter price gouging by these owners of small convienience type stores. guess it was ok while it lasted. expecting to see some great deals on injector machines all over e-bay etc. govenment has nothing better to do but put the honest vendors out of business. can smell the 'end' coming kids. and its sad. :coffee:

Well, I emailed my Oklahoma senators and let's see what happens. I did do some internet research this morning and wow, lot's of different points of interest on this bill. Why in the hell are tobacco/smokers alike, always in the same sentences with terroists. They just use what ever the hell they can to put scare tactics in to the uninformed. Yes, even with the internet today, there are tons of uniformed individuals out there. However, the indian population is really chimming in on this bill and they are against it. There is a tribe in New York that has threatened to shut down a major interstate section that runs through their land. The indian tobacco sells will take a huge hit if this thing passes. I've also done some reading on different blogs/forums that even non-smokers are against this because even they agree that tobacco has been taxed out the yeng-yang and some view this as the stepping stone for big Gov. to start getting involved with internet sales and/or restrictions. Don't know what will happen to "us" if this bill passes. There are no DR brands available to me within a 10 hour drive, so that ain't going to happen for me. Like most, will stock up on some, but sooner or later, those bastards are going to get a "win" from me. I mean, I will stop smoking. There, I said it. Don't want to, but let's face it. We're being singled out and eventually we're going to be extinct. I'm also tired of paying these rediculus prices and now, I won't be able to buy the stuff anyway. OK assholes, you win....now let's see what happens when that revenue ceases. I know that I WON'T BE ALONE in this decision. There is a point in a persons life that you just have had enough. It's not about so much the prices, as we've been through this crap before, but now it's about just trying to get the stuff. If there was anyway you could, it would all be under the table. Say you could, or had a buddy, that could get you DR or some other brand of tobacco. They will have to buy it at the site, so now your hit with all that tax. Then, they'd have to ship it to you somehow with out USPS being supicious. If, somewhere in that process, someone gets caught, felony offense. That's just too much to risk from a friend or family member. Maybe the nicotine vaccine will be out by then....ya'll heard about that yet?

i really agree with you schmoe, the only real leverage we have going is the indian stance on all of this. that wont be enough in itself but it does count for something. in the end most will not quit and the big wigs at rj reynolds and phillip morris will win again as we are forced to buy their crappy overpriced products. i think its all a matter of time as their lobby is so powerful, huge really! scary to think in this day and age that tryin to save a buck ignites such a furious response. really unbelievable. im waiting for a delivery as i type but how much can one afford to stock up. and dont forget the pipe tobacco loophole; can feel that one closing day by day. i read the pipe tobacco mfgs have more than tripled sales and production since april. that will not be tolerated by the big-wig premade moguls. you can bet on that, fer sure dude!!!! you know i was told the recent shortage of zen tubes was due to manufacturing issues. that has to be tied into the resurgence and tax issues with the pipe tobacco thing. and all this as pot gets closer and closer to some twisted form of legality and acceptance. what a wacky group we have in washington. oh well now ive worked myself up to having a nice relaxing roll my own pipe tobacco cigarette, damn! rclear666 out :coffee:

Wonder how many of us would actually quit smoking because of this? If so, why? Would be "it's the principal, dammit," or "ain't giving any of those bastards my money" or just couldn't afford it or quit because you couldn't stand the taste of a premade.
I'll say this, I'm a big fan of democracy and captialism, but it seems like the old saying goes, the rich get richer. Think about it, the big companies lobby the crap out of congress, get them on their coat tails and they pass this legislation all the time knowing it will absolutely kill the competition. Now, my brother and sisters, is that power or what? I'm mean, that's is scary power. As mentioned above, you'd be force to buy their products over the counter with no regard to quality and on top of that, having to smoke those nasty ass FSC tubes.
With all that in mind and maybe the Indians could lobby together or something, but we've beat the SCHIP crap (so far) and USPS is still shipping tobacco. Now, how could we beat this? Even if DR loaded up a semi-trailer full of tobacco and drove around different states and arranged a sale location, we'd still have to pay that awful high tax. Or would we? Let's say that, example now, a bunch of us close to the Oklahoma City area got together and agreed with DR to buy X amount of pounds of Windsail Plat. Mark at DR loads it up, drives to a location in Oklahoma City at a specified time, then "we" showed up, paid for our order, or pre-paid for that matter, of pipe tobacco and off we went. Then, they would have the age verification proof that all the anti-tobacco assholes have been using as a scape goat. Now, how would that work tax wise? Something tells me this won't fly because of business license or some other bull, but could something like that be even possible? Even if you had a indian tobacco shop nearby and they agreed to sell DR, they could sell it at whatever price they wanted to and then they would have a monopoly on that product. Man, this just sucks.
